Service terms

1. Eligibility to use the Service

You must be at least 18 to access the Service. By using it, you confirm that you meet this age threshold and have the legal capacity to accept these Terms. The Service must not be used where applicable law disallows it.

2. Account registration

Full functionality requires an account with complete, accurate and up-to-date information. You must keep your credentials secure and are responsible for activity carried out through your account. If you suspect unauthorised access, contact us promptly at [email protected] when you think another person has accessed the account without authorisation.

We can suspend or terminate accounts that violate these Terms, contain deceptive information or are involved in fraudulent or abusive activity.

3. Service scope and limitations

Trading Elevate provides AI-supported market research, trading indications and, where available, automated order placement through connected broker accounts. The Service is intended solely for information and analysis.

• Trading Elevate does not hold, safeguard or manage your money. Your capital stays within your own brokerage or exchange account.
• We connect to your broker through API keys limited to reading and executing actions. These credentials do not permit withdrawals.
• Past performance from a strategy or signal is not a reliable indication of future performance.
• Trading is risky and may result in the loss of the capital you commit.

4. No investment guidance

No content made available through the platform Trading Elevate constitutes financial, investment, trading or other professional advice. AI outputs and research are supplied for general information only. You should consider obtaining advice from a suitably qualified financial adviser before making investment decisions. Trading Elevate is not registered as an investment adviser, broker-dealer or financial planner.

5. Charges and payment

Some Service features require a paid subscription. Prices are shown on the pricing page and may be amended with 30 days’ notice. Applicable taxes are excluded and remain your responsibility. Subscriptions are billed in advance on a monthly or annual basis. At our discretion, a new subscriber may qualify for a refund within 14 days of the initial charge.

6. Permitted use

You agree not to:

• Use the Service for unlawful purposes or in breach of applicable law.
• Reverse-engineer, decompile or disassemble the platform, or try to obtain its source code.
• Use automated tools to scrape, crawl or gather data from the Service.
• Resell, sublicense or exploit any part of the Service commercially without prior written consent.
• Interfere with the Service, its security, performance, integrity or underlying infrastructure.
• Engage in market manipulation, front-running or other behaviour that conflicts with financial regulation.

7. Intellectual property rights

All content, code, algorithms, trade marks and confidential know-how forming part of or delivered through the Service are owned solely by Trading Elevate or its licensors. Nothing in these Terms grants ownership of, or other rights to, that content. Our trade marks and logos require prior written consent for use.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF QUALITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Trading Elevate WE DO NOT GUARANTEE CONTINUOUS OR ERROR-FREE OPERATION, NOR THAT THE SERVICE WILL BE FREE OF VIRUSES OR OTHER DAMAGING COMPONENTS.

9. Liability limitations

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, Trading Elevate WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY LOSS, INCLUDING LOST PROFITS, DATA LOSS, TRADING LOSSES OR BUSINESS INTERRUPTION, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF SUCH POSSIBILITY WAS NOTIFIED. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID TO Trading Elevate IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Your indemnity obligations

You agree to indemnify, defend and hold harmless Trading Elevate and its directors, officers, employees and agents from claims, liabilities, losses, damages and expenses, including reasonable legal costs, arising from your use of the Service, violation of these Terms or infringement of another person’s rights.

11. Termination of these Terms

You may close your account from its settings or by writing to [email protected]. We may suspend or terminate access immediately after a breach. Once access ends, your permission to use the Service stops, and account information may be deleted in accordance with our Privacy Policy.

12. Applicable law and dispute resolution

These Terms are governed by the law of the State of New York, USA, without applying its conflict-of-law rules. Disputes must first go to binding arbitration in London under American Arbitration Association rules. Individuals in the EU or UK may also submit complaints to the courts available under their local law.

13. Amendments to these Terms

We may revise these Terms periodically. We will give at least 14 days’ notice of material changes by email or through a Platform banner. Continuing to use the Service after the effective date indicates acceptance of the updated Terms.
